Copyright Infringement Issure Related With Associated Content?

Posted by Copyright Law Enquirer on July 13th, 2009 at 04:26am

I may have found something that is copyright infringement on associated content..
What exactly happens if it’s reported?
Does associated content nail down on the writer? Or is the content simply removed?
Is the writer charged with criminal offenses?
Thanks.

The writer is not going to be charged with criminal offenses. If it is reported, then the content will most likely just be taken down. If the copyright owner wishes, they can file a claim (read: sue) for copyright infringement, but they are going to have to show damages to get anything worthwhile out of it, and I’m sure that would be hard .

The copyright owner can file a complaint with the service provider’s designated copyright agent and has procedures to follow with verifying the report and removing the infringing content, or face lawsuit as a contributory infringer. Yes, it is quite possible to be criminally liable for copyright infringement, although somewhat difficult to get a local US Attorney to make it a priority. If the copyright is registered (in the USA) then there could be “statutory damages” of hundreds of thousands of dollars, even if the owner could not prove any actual damages.
