I would assume that YouTube content that is owned entirely by the person who uploads it (this excludes videos that contain copyrighted materials) and is set to public becomes part of the public domain. It’s as if they were performing in a public place and you were there too. You’d have every right to record their activities.
If people expect copy protection for their videos, they’d be foolish to place them in a public arena.
However… if they post a video, their ideas and images are their property. It would be illegal for someone to take someone else’s work and pass it off as their own.
There… I just confused myself!! I hope that was helpful.

you shouldn’t download anything anyone else has posted without their permission– that’s not only illegal, it’s rude as well.
posters on youtube can upload anything that’s theirs– if it’s a band’s site for example, probably the band manager or someone like that is running the site, and they have the right to upload those things.
oh and, i’m a youtuber myself, and i’ve read all thru the rules and guidelines of youtube. what is posted is property of the poster, not youtube.

If you dont ask the owner, it can be classed as copyright infringement, but the law is quite complex and detailed. I wouldn’t worry about it too much, as it probably says in the YouTube T%C’s somewhere that anything uploaded becomes the property of YouTube.

Youtube clearly states that copyright material is not to be posted to the site. By the same token if you did not create the content then you can not use the content.
