I am in Canada. but if you have information about the copyright act in other countries, it could be the same.
Actually I want to use the photos in a commercial software.

No you can not. The reason is that you want to make money off the photos. Barbie is owned by Mattel and has all rights to its look and commercial use. Now if you photograph generic jewelry, something that looks like all the rest, you will be okay.

No, you can not. You have to inquire the original copyright holder permission to use it for commercial purposes. Otherwise they can sue you for it.

Yes you can. As long as you don’t sell them as the original.
